You mean proof that an offence has been committed is not presently required for a fine or proceedings to be issued? Requiring evidence is not 'Utopian' it's perfectly normal. Here, for example, the police use a mixture of roadside cameras (single point and average speed) and calibrated video built into their vehicles. Absent such proof, and as much as I hate to say it, a lawyer defending an accused client aren't 'lying for defendants', they're doing their job (which should be remarkably easy without proof of an offence). With such proof, the lawyer's role is to argue mitigation (or to question the accuracy/validity thereof: 'That photo clearly shows a large white man driving a pick up truck, my client is a small black woman who drives a Prius') |
